A Miami Shores psychiatrist has been sentenced to six years in federal prison and ordered to repay Medicare and Medicaid $ 1.7-million in phony claims, the U.S. Attorney’s Office in Tampa said.

Nestor A. Garcia, 43, had provided recreational activities at adult care facilities in the Tampa Bay area, then had billed the federal government for psychiatric services he had not provided, a U.S. Attorney’s Office news release said.

Garcia’s two companies, C.A.R.E.S. Inc. and ACLF Medical Services Inc., had operated in Pinellas, Pasco, Hillsborough and Polk counties. He submitted more than $ 4.5-million in fraudulent claims in 1994 and 1995, the news release said.

In December, Garcia was convicted of one count of conspiring to defraud the United States and 15 counts of submitting false claims to Medicaid and Medicare. In addition to the prison time and restitution, Garcia also must serve three years of probation upon his release.
